En su opini\u00f3n, <strong>la \u00fanica definici\u00f3n legislativa en la que &#8220;posiblemente&#8221; podr\u00eda encajar XRP es la de contrato de inversi\u00f3n.<\/strong><\/p>\n<p style=\"text-align: justify\">Sin embargo, estableci\u00f3 que sin una obligaci\u00f3n para Ripple de hacer nada excepto transferir el activo, XRP no puede considerarse un contrato de inversi\u00f3n.<\/p>\n<p style=\"text-align: justify\">Hogan destac\u00f3 adem\u00e1s que la prueba Howey utilizada para determinar si una transacci\u00f3n califica como un contrato de inversi\u00f3n requiere un &#8220;contrato&#8221; de alg\u00fan tipo.
