En cambio, <strong>las compradas antes de la boda o recibidas por donaci\u00f3n o herencia seguir\u00edan siendo bienes privados<\/strong>, tal como se\u00f1ala la exposici\u00f3n de motivos.<\/p>\n<p><strong><a href=\"https:\/\/thecryptocurrencypost.net\/es\/el-banco-de-rusia-impulsa-la-tokenizacion-de-acciones-para-atraer-inversores-extranjeros-pese-a-sanciones\/\" target=\"_blank\" rel=\"noopener\">La propuesta de Rusia<\/a> llega en un contexto de alto volumen de mercado<\/strong>: entre julio de 2024 y junio de 2025 se registraron transferencias por 376 300 millones de d\u00f3lares, cifra usada como argumento para actualizar el marco legal. <strong>Desde 2021, la Ley Federal n.\u00ba 259-FZ reconoce ciertos activos digitales como propiedad<\/strong>, pero no regula qu\u00e9 ocurre en un divorcio; <strong>el nuevo texto busca cubrir ese vac\u00edo<\/strong>. Andrey Tugarin, fundador de GMT Legal, la califica de \u00abinefectual\u00bb si no se acompa\u00f1a de <strong>mecanismos para identificar y seguir los activos digitales<\/strong>, y estima que har\u00e1n falta <strong>hasta diez normas adicionales<\/strong>. A su juicio, <strong>la ausencia de un estatus oficial para los participantes del mercado y la falta de obligaciones de intercambio de datos<\/strong> dejan puertas abiertas para ocultar cripto.<\/p>\n<p><strong>Persisten obst\u00e1culos operativos en la valoraci\u00f3n, trazabilidad y cooperaci\u00f3n institucional<\/strong>, como fijar precios en momentos de alta volatilidad, rastrear carteras y exchanges que no colaboran, y establecer protocolos para que jueces y entidades compartan informaci\u00f3n.<\/p>\n<p>Aunque surgen algunas dudas sobre su alcance legal, ya que con esta propuesta las criptomonedas compradas durante el matrimonio se consideran bienes gananciales. Por lo tanto, se necesitan nuevas normas que permitan trazabilidad y registro.<\/p>\n<p><strong>El proyecto est\u00e1 en manos del Gobierno y del Banco Central<\/strong>, y <strong>no se espera que los desarrollos regulatorios necesarios est\u00e9n listos antes de 2027<\/strong>.
