La demanda fue estructurada para <strong>contemplar cambios futuros de control, al incluir a cualquier persona que se convierta en propietaria o controladora del exchange o de sus canales promocionales hasta el 31 de octubre de 2028.<\/strong><\/p>\n<p>Este enfoque preventivo refleja la intenci\u00f3n de la <strong><a href=\"https:\/\/www.fca.org.uk\/news\/statements\/htx-huobi-legal-proceedings\" target=\"_blank\" rel=\"noopener noreferrer\">FCA<\/a> de evitar que modificaciones societarias o de gobernanza limiten el alcance de la acci\u00f3n legal<\/strong>. Al extender la ventana de control futuro, el regulador busca asegurar que la demanda siga siendo efectiva incluso si cambian los responsables operativos del exchange.<\/p>\n<h2>La importancia de marcar un precedente para la FCA<\/h2>\n<p>Seg\u00fan la FCA, <strong>HTX continu\u00f3 difundiendo promociones financieras dirigidas a consumidores del Reino Unido a pesar de haber recibido advertencias previas.<\/strong> Las presuntas promociones ilegales habr\u00edan aparecido tanto en el sitio web del exchange como en redes sociales, y el regulador cuestion\u00f3 la <strong>falta de transparencia de la plataforma respecto de sus beneficiarios finales y su liderazgo operativo.<\/strong><\/p>\n<p>La FCA reconoci\u00f3 que <strong>HTX tom\u00f3 medidas para restringir nuevos registros de clientes del Reino Unido tras el inicio de las acciones legales.<\/strong> Sin embargo, sostuvo que<strong> los usuarios brit\u00e1nicos existentes segu\u00edan teniendo acceso a promociones consideradas ilegales y que la empresa no ofreci\u00f3 garant\u00edas de que dichas restricciones fueran permanentes o plenamente efectivas.<\/strong><\/p>\n<p>Desde el punto de vista regulatorio,<strong> la demanda se enmarca en la aplicaci\u00f3n del r\u00e9gimen de promociones financieras de criptoactivos que entr\u00f3 en vigor en octubre de 2023<\/strong>.
